PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THESE SITES.

This is a binding agreement ("Agreement") between DNSstuff, LLC d/b/a DNSstuff and each person who uses this websites ("You" or "Your"). This Agreement governs Your use of the websites (www.dnsstuff.com and www.dnsreport.com (the "Sites)", including, without limitation, all content such as text, information, news, images, contracts, software and other downloadable material (collectively, the "Materials") and all services (the "Services") made available to You through these sites by DNSstuff and/or third parties.

BY USING THESE SITES, YOU AGREE TO THE TERMS OF THIS AGREEMENT.

1. Limited License

   Our affiliate program grants You a non-exclusive limited license to use our logos and banners to promote DNSstuff to Your customers. You may not modify, copy or attempt to redistribute or resell our products without prior written consent from our company.

2. Assignment

   You may not assign or transfer this affiliate license to anyone without prior written approve from our company. DNSstuff may assign this Agreement, in whole or in part, in its sole discretion.

3. Third Party Info

   DNSstuff may use some third party information in our application. You agree that our company will not be liable for Your use or Your customer's use of this third party information.

4. Promoting the program

   You may use our affiliate links anywhere on Your website or emails to Your customers. You agree not to send unsolicited email and spam that contains links to our site. We have a strict no-spam policy and You agree to provide evidence that customers and prospects have signed up to receive email from You in the event that a customer complains to us about spam from You regarding this affiliate program.

5. Commission

   You can review Your performance under the "My Account" tab at DNSstuff. You earn 15% commissions on the gross sales for all purchases that are completed via Your affiliate link. Visitors that come to our site via Your link will receive a cookie on their computers lasting 60 days. You will receive the 15% commission for visitors who come back to DNSstuff.com and purchase during that 60 day period. Refunds are accepted with 14 days after purchase. Any refunds for Your customers will be deducted from the commission earned. Your commission payments will be process via check once Your limit reaches $150 of commissions earned.

6. Indemnification

   You agree to defend, indemnify and hold DNSstuff, its parents, subsidiaries, affiliates and their respective members, directors, officers, employees, stockholders and agents harmless against any losses, expenses, costs or damages (including DNSstuff's reasonable attorneys' fees and other reasonable costs of litigation) arising from, incurred as a result of, or in any manner related to (1) Your breach of this Agreement, (2) Your unauthorized or unlawful use of the Sites, the Materials or the Services, or (3) the unauthorized or unlawful use of the Sites by any other person using Your IDs.

7. Dispute Resolution

   Any dispute between DNSstuff and You arising out of this Agreement shall be resolved first by direct communication with one or more of DNSstuff's customer service representatives. Should DNSstuff and You be unable to resolve the dispute by communication, either DNSstuff or You may submit any dispute arising out of or relating to this Agreement, or the breach thereof, to final and binding arbitration administered by the American Arbitration Association nearest the place of DNSstuff's headquarters and pursuant to Massachusetts law. The arbitrator shall fully implement the intent and purposes of this Agreement and indemnify non-breaching parties for and hold them harmless from all losses, costs, and expenses (including costs of arbitration and reasonable attorneys' fees) resulting from any breach or from defending against any allegations of a breach determined to be unfounded.
